These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and USVisaPhotoAI ("Company," "we," "us," or "our") governing your access to and use of the USVisaPhotoAI website, tools, and services (collectively, the "Service"). By accessing or using the Service in any manner, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
Your use of the Service constitutes your full acceptance of these Terms, our Privacy Policy, and our Refund Policy, all of which are incorporated herein by reference. We reserve the right to amend these Terms at any time at our sole discretion. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. USVisaPhotoAI provides an AI-powered tool to crop, resize, reformat, and perform a technical compliance check on photos against publicly available biometric photo standards (such as those published by the U.S. Department of State). The Service produces a formatted digital image file as output.
USVisaPhotoAI is not affiliated with, endorsed by, or in any way connected to the U.S. Government, the U.S. Department of State, the U.S. Department of Homeland Security, any U.S. embassy or consulate, or any other government authority. Our service is an independent commercial tool and does not guarantee visa or passport approval or the acceptance of any photo by any government agency.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

While our AI tool is designed to produce technically compliant outputs, we make no guarantee, representation, or warranty that any photo processed by our Service will be accepted by any government agency, portal, embassy, consulate, or any other authority. Acceptance decisions rest entirely with the reviewing entity. We are not liable for any rejection, delay, or consequence arising from the non-acceptance of a photo processed by our Service.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL USVISAPHOTOAI, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO US FOR THE SPECIFIC TRANSACTION GIVING RISE TO THE CLAIM IN THE 30 DAYS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless USVisaPhotoAI and its owners, officers, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content or photo you submit through the Service.
All content, software, technology, trademarks, and materials on the Service (excluding your uploaded photos) are the property of USVisaPhotoAI or its licensors and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
By uploading a photo to our Service, you grant USVisaPhotoAI a limited, non-exclusive, royalty-free license to process and transform your photo solely for the purpose of providing the Service to you. This license does not extend to using your photo for any other commercial purpose.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in India. You waive any objection to such jurisdiction and venue.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and USVisaPhotoAI with respect to the Service and supersede all prior agreements, understandings, and representations.
